Interpretation and Definitions

Interpretation

Words with an initial capital letter have meanings defined below. Definitions apply in both singular and plural form.

Definitions

  • Company ("We", "Us", "Our") refers to Zapi, operating at zapi.co.za.
  • Service refers to the Zapi website and platform accessible at zapi.co.za.
  • User ("You", "Your") means any individual or entity accessing or using the Service.
  • Business Profile means a listing created by a User to represent their business on the Zapi platform.
  • NFC Card means a physical Near Field Communication card ordered through the Service.
  • Content means any information, text, images, or data submitted to the Service by a User.

Acceptance of Terms

By accessing or using Zapi you agree to be bound by these Terms. If you do not agree, you may not use the Service. You must be at least 18 years old to create an account.

Use of the Service

You may use Zapi to create and manage a digital business profile, order NFC cards, and list your business in the Zapi directory. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

You agree not to use the Service to post false or misleading business information, to impersonate another person or business, to violate any applicable South African law, or to engage in any activity that disrupts or damages the Service.

Business Profiles and Content

You retain ownership of the content you submit to your Zapi profile. By submitting content you grant Zapi a non-exclusive, royalty-free licence to display that content as part of the Service. You represent that you have the right to submit all content you provide and that it does not infringe any third-party rights.

Zapi reserves the right to remove any content that violates these Terms or that we determine, at our sole discretion, to be inappropriate.

NFC Cards and Payments

Orders for NFC cards are subject to the pricing published on the Zapi pricing page at the time of order. Payment is processed by PayFast. Once an order is confirmed and sent to production it cannot be cancelled. Refunds are considered on a case-by-case basis for defective products.

Limitation of Liability

To the maximum extent permitted by South African law, Zapi and its directors, employees, and agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim will not exceed the amount you paid to Zapi in the 12 months preceding the claim.

Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the courts of South Africa.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or by a notice on the Service at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
